1. USER ELIGIBILITY AND AGE VERIFICATION
Access to the Platform and use of the Services is strictly limited to individuals who:
- Are natural persons aged 18 years or older;
- Are physically located within Australia at the time of access;
- Are not subject to any legal restriction, regulatory exclusion, or platform ban that prohibits their participation.
We implement mandatory technical and procedural controls to verify the identity and age of all users, including through document verification, geolocation, and automated screening systems. You expressly agree to cooperate with all verification requests, including submission of government-issued identification and supporting documentation.
We reserve the right to suspend, restrict, or permanently deny access to any user whose eligibility cannot be conclusively established.
2. DESCRIPTION OF SERVICES
Play Australian Games is a fully digital lottery platform that enables eligible users in Australia to purchase official lottery tickets from authorised Australian retailers via an online interface. The Platform operates exclusively as a digital facilitation service and does not itself conduct any lottery draw or game of chance.
- Lawfully acquired from authorised lottery retailers within Australia;
- Fulfilled through physical purchase and scanned into the customers digital account;
- Held in trust for the benefit of the customer;
- Associated with automatic result checking and prize notification;
- Eligible for direct prize payment into the users account in accordance with governing lottery rules.
We are not affiliated with, endorsed by, or a direct licensee of any lottery operator. Our role is limited to fulfilment, delivery, and account management.
3. LEGAL NATURE OF LOTTERY COURIER MODEL
The Platform operates under a legal lottery courier model. We are not a lottery operator and do not conduct or facilitate betting or wagering. Each purchase made through the Platform corresponds to the acquisition of a real ticket, sourced from a licensed Australian lottery retailer.
By using the Platform, you:
- Acknowledge that you are not wagering on draw outcomes but purchasing a valid entry to an official lottery draw;
- Understand that the ticket is held in trust for your benefit and that we act as a service provider for fulfilment, ticket management, and prize handling;

4. ACCOUNT REGISTRATION AND VERIFICATION

7. INTELLECTUAL PROPERTY AND LICENSING
All content, functionality, and intellectual property displayed or made available through the Platform—including but not limited to software, source code, designs, trademarks, logos, text, graphics, and audiovisual elements ("Platform Content")—is either owned by, or lawfully licensed to, The Play Australian Games website and is protected by Australian and international intellectual property laws.
Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform Content solely for your lawful personal use in connection with the Services.
You must not:

Termination of your account does not affect any accrued rights or obligations under these Terms. We are not liable for any loss, refund, or inconvenience arising from termination, suspension, or closure of your account.
13. LIABILITY DISCLAIMERS
To the fullest extent permitted by law, all Services are provided on an as is and as available basis, without warranties of any kind, express or implied.
Without limiting the foregoing:

- We make no assurances regarding draw outcomes, winning probabilities, or results notifications;

- We do not guarantee that the Platform or Services will be compatible with all devices, operating systems, or software configurations.
You acknowledge that your use of the Services involves inherent risk, including potential financial loss, and that you assume full responsibility for your participation.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, warranty, or right that cannot be lawfully excluded under the Competition and Consumer Act 2010 (Cth).
14. LIMITATIONS OF LIABILITY
Subject to any non-excludable rights under the Australian Consumer Law:
- We are not liable for any indirect, consequential, incidental, punitive, exemplary, or special loss or damage, including loss of data, profits, revenue, opportunity, or goodwill;
- We are not liable for any failure, delay, or disruption caused by events beyond our reasonable control, including third-party failures, outages, or force majeure events;

- We are not liable for unauthorised access to your account resulting from failure to maintain credential confidentiality.
To the extent permitted by law, our maximum aggregate liability to you for any claim arising out of or in connection with the Services is limited to the lesser of:
- The amount paid by you for the lottery ticket related to the claim; or
- AUD $100.
This limitation applies regardless of the nature of the claim, whether based in contract, tort (including negligence), statute, equity, or otherwise.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be lawfully excluded under Australian law.
15. INDEMNITY AND REIMBURSEMENT
You agree to fully indemnify, defend, and hold harmless The Play Australian Games website, its directors, officers, employees, contractors, licensors, and affiliates from and against all losses, liabilities, claims, damages, costs, fines, penalties, or expenses (including reasonable legal fees on a full indemnity basis) arising out of or in connection with:

You irrevocably submit to the exclusive jurisdiction of the courts of the Northern Territory and all relevant Australian federal courts for the resolution of any dispute arising under or in connection with these Terms, the Platform, or the Services.
If you access the Platform from outside Australia, you do so at your own risk and are solely responsible for compliance with all applicable local laws.
